Wages, Benefits and Fair Pay
Arizona has a statute that governs the payment of wages and the ramifications of an employer failing to timely do so, including the possibility of being hit with treble damages. What often is overlooked, however, is that Arizona also has a statute that sets forth when an employer can legally withhold wages otherwise due an employee.
There is also federal law that prohibits the discriminatory payment of wages. The law was amended in 2009. The amendment is known as the Lilly Ledbetter Fair Pay Act.
Failure to pay employee benefits is also an area of our practice. In one such case, the U.S. District Court found in favor of the firm’s client, specifically finding that his employer breached its retirement plan contract by refusing to pay him benefits. The 9th Circuit Court of Appeals affirmed the decision. This outcome, however, is case specific and the firm cannot make any guarantee of a similar outcome in any other particular case.
